June 2010: OMVWI .15 or greater (class a misdemeanor), operating a vehicle while intoxicated (class c misdemeanor), operating a vehicle while intoxicated with a prior conviction (class d felony), operating a vehicle while intoxicated with a prior conviction (class d felony)- pleaded guilty to count I, enhanced to class d felony. Sentenced to Indiana Department of Corrections for 18 months, suspended on the condition the defendant serve 18 months on AAPS (alcohol abuse probation services). Driving privileges suspended 2 years. Upon successful completion of the sentence the defendant may petition the court for judgment to be amended to a class a misdemeanor. Petition to revoke- Aug. 2010- sentenced to 30 days at the Vanderburgh County Jail with 9 days credit, plus good time. Petition to revoke AAPS – October 2010- sentenced to 18 months at the IDC for 18 months – sentence to be served on Vanderburgh County Work Release with credit for 32 days.
